Terms of Use

Applies to rothwise.ai and to reports produced through it.

Draft for the owner's counsel. Oriented to protect RothWise and the owner of the brand. Sections 2 and 3 describe how the software actually behaves, read from its own source and configuration rather than from a template — in particular that entered figures are not stored, which is also the backbone of the Privacy Policy. Jurisdiction and the contact address are marked in the text as the owner's to supply. Delete this notice when the text is approved.

1. Who these terms are between

These terms are between you and the owner of rothwise.ai and the RothWise™ brand ("RothWise", "we", "us"). By using this site or any report produced through it, you agree to them. If you do not agree, do not use the site.

2. Two surfaces, and they are governed differently

These terms cover two things, and the distinction matters.

3. The calculator is a tool for licensed professionals

RothWise is calculation software, made available to licensed financial professionals for use in their own practice. The professional enters the figures; the software performs the calculation and returns a report. The figures are used to produce that report and are not stored by us — see the Privacy Policy, section 4, for exactly what that means.

A report produced through RothWise is an illustration generated from the figures entered, and it is issued by the professional under their own name. That document is the professional's. Where it is saved, who it is sent to and how long it is kept are entirely their decisions, on their own systems. The professional is responsible for the accuracy of what they enter, for the suitability of anything they recommend, for the handling of their client's information once a report exists, and for their own compliance obligations.

Because we do not keep the figures, we cannot retrieve, reissue, audit or reconstruct a report after the fact. A professional who needs a record of a report must keep their own copy.

4. What RothWise does not do

RothWise does not provide tax, legal, accounting or investment advice, does not make recommendations to any individual, and does not act as a fiduciary to any client of any professional who uses it. Nothing on this site and nothing in a report is an offer, a solicitation or a promise of any outcome.

5. Illustrations and assumptions

Outputs are projections. They are produced from the figures entered, from published tax and Medicare constants current at the time the engine was built, and from stated assumptions including rates of growth and the timing of distributions. Tax law, published amounts and market conditions change. Actual results will differ. Figures are not guaranteed. Sample figures shown on the site are a hypothetical example and are not drawn from any real household.

6. Intellectual property

The RothWise™ name and logo, the report design, the page layout and colour system, the calculation engine, the site and all copy on it are owned by us and are protected by trademark and copyright. RothWise™ is a trademark of the owner of rothwise.ai, and applications covering it are on file with the United States Patent and Trademark Office. You may use a report produced for your own client in your own practice. You may not copy, reproduce, adapt, reverse-engineer, resell, sublicense or create derivative works from the site, the engine or the report design, and you may not remove or alter any RothWise name, mark, notice or attribution from a report.

7. Acceptable use

You agree not to use the site to break the law, to infringe anyone's rights, to attempt to gain unauthorised access to any system, to interfere with its operation, to scrape or bulk-extract its content, or to present its output as your own product or as anything other than an illustration.

8. No warranty

The site and all output are provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the site will be uninterrupted, error-free or that any figure is free of error.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, lost business, lost data, or loss arising from any decision made or action taken in reliance on the site or any report. Our total liability for any claim relating to the site is limited to the amount you paid us for access to it in the twelve months before the claim arose.

10. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, liability or expense, including reasonable legal fees, arising from your use of the site, from any report you issue, from anything you recommend to a client, or from your breach of these terms.

11. Changes, suspension and termination

We may change these terms, the site or the calculation engine at any time. We may suspend or end your access at any time. Continued use after a change means you accept the revised terms.

12. Governing law

These terms are governed by the laws of the state identified by us, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there. (Jurisdiction to be set by the owner.)
